What Is Bill 122?
Bill 122 (An Act to amend the Building Act, in effect since March 2013) was adopted by the Régie du bâtiment du Québec (RBQ) following tragedies linked to falling materials from poorly maintained facades in Montreal. It now requires mandatory periodic facade inspection for any building with at least one facade of 5 storeys or more above ground, regardless of its use (residential, commercial, institutional, condominium), as well as for multi-level parking garages with at least one structural concrete slab used as a driving surface.
The facade refers to the building's exterior walls as well as all elements attached to them, whether permanently or temporarily — balconies, awnings, chimneys, antennas, cladding, anchors, and decorative elements.
Here are the key requirements of Bill 122:
- First inspection: before the building's 10th construction anniversary (12 to 18 months after construction for multi-level parking garages)
- Frequency: a complete inspection every five (5) years
- Who can sign it: an inspection report must be signed by an engineer who is a member of the Ordre des ingénieurs du Québec (OIQ) or an architect
- Retention requirement: reports must be kept on-site and available to the RBQ
- Responsibility: it falls to the building owner or, in the case of a condominium, the condo syndicate
