Since Bill 16 was adopted in 2020, the Quebec Civil Code requires every divided co-ownership syndicate to have a contingency fund study carried out by a qualified professional, then updated at least once every five years. This requirement applies to small three-unit condos just as much as large residential towers, whether the building is in Montreal, Laval, the South Shore, or even Sherbrooke.

The goal is simple: prevent co-owners from facing an unexpected special assessment when a roof, central heating system, or underground parking garage reaches the end of its useful life. Cost and Update Frequency

The cost of a study varies with the size of the condo, the number of units, and the complexity of its systems, but an update is required at least every five years, or sooner if major work significantly changes the building's condition. Many syndicates choose to spread this cost across the operating budget rather than treat it as an exceptional expense.

It's also wise to have the study revisited after a major incident, such as significant water damage or a fire, since these events can accelerate the deterioration of certain components and shift the replacement timeline originally projected.

The Board's Role After the Study Is Delivered

Receiving the study is only the first step: the board must then present the results to co-owners, adjust contingency fund contributions accordingly in the next budget, and track the proposed replacement timeline over the following years. A board that receives a study without factoring it into its budget decisions exposes the syndicate to the same risks as one that never commissioned a study at all.
